17519 - Ishaq ibn Sulayman (meaning al-Razi) narrated to us, saying: I heard Malik ibn Anas and Ishaq ibn Isa both say: Malik informed me from al-Zuhri from Uthman ibn Khurshah, while my father, and Ishaq ibn Isa said, from Uthman ibn Khurshah, that Abdullah said: And Mus'ab al-Zubayri narrated to us from Malik a similar report, saying that Uthman ibn Ishaq ibn Khurshah was from the Banu Amir ibn Lu'ay, and none narrated it from al-Zuhri as an isnad except Malik from Qabisah ibn Dhuwayb, who said: A grandmother came to Abu Bakr (ra) asking him about her inheritance. He said: I do not know anything for you in the Book of Allah, nor do I know anything for you in the Sunnah of the Messenger of Allah (peace be upon him and his holy progeny), until I ask the people. So he asked, and al-Mughira ibn Shu'ba said: I heard the Messenger of Allah (peace be upon him and his holy progeny) assign her one-sixth. He then asked: Who can witness with you or who knows with you? Muhammad ibn Muslimah stood up and said the same, so he fulfilled it for her. And Ishaq ibn Isa said: Is there anyone with you besides yourself?

Hadith No: 2

Qabisah bin Dhuw'aib said: "A grandmother came to Abu Bakr to ask him about her inheritance. He said to her, 'There is noting for you in the Book of Allah and there is nothing for you in the Sunnah of the Messenger of Allah (s.a.w.a.). So ,return until I ask the people. So he asked the people and Al-Mughirah bin Shu'bah said: 'I was present when the Messenger of Allah (s.a.w.a.) gave her (case) a sixth.' So he said: 'Was anyone else with you?' Muhammad bin Maslamah stood to say the same as what Al-Mughirah bin Shu'bah said. So Abu Bakr implemented that for her." Then the other grandmother came to 'Umar bin Al-Khattab to ask him about her inheritance. He said: 'There is nothing in the Book of Allah for you, but there is that sixth. So if the two of you are together then it is for both of you, and whichever of you remains), then it is for her.'"

Hadith No: 3

Narrated Qabisah ibn Dhuwayb: A grandmother came to AbuBakr asking him for her share of inheritance. He said: There is nothing prescribed for you in Allah's Book, nor do I know anything for you in the Sunnah of the Prophet of Allah (s) Go home till I question the people. He then questioned the people, and al-Mughirah ibn Shu'bah said: I had been present with the Messenger of Allah (s.a.w.a.) when he gave grandmother a sixth. AbuBakr said: Is there anyone with you? Muhammad ibn Maslamah stood and said the same as al-Mughirah ibn Shu'bah had said. So AbuBakr made it apply to her. Another grandmother came to Umar ibn al-Khattab asking him for her share of inheritance. He said: Nothing has been prescribed for you in Allah's Book. The decision made before you was made for a grandmother other than you. I am not going to add in the shares of inheritance; but it is that sixth. If there are two of you, it is shared between you, but whichever of you is the only one left gets it all.

Hadith No: 4

It was narrated that Ibn Dhu’aib said:

“A grandmother came to Abu Bakr Siddiq and asked him for her inheritance. Abu Bakr said to her: ‘You have nothing according to the Book of Allah, and I don’t know of anything for you according to the Book of Allah, and I don’t know of anything for you according to the Sunnah of the Messenger of Allah (s.a.w.a.). Go back until I ask the people.’ So he asked the people and Al-Mughirah bin Shu’bah said: ‘I was present with the Messenger of Allah (s.a.w.a.) and he gave her (the grandmother) one sixth.’ Abu Bakr said: ‘Is there anyone else with you (who will corroborate what you say)?’ Muhammad bin Maslamah Al-Ansari stood up and said something like what Mughirah bin Shu’bah had said. So Abu Bakr applied it in her case.”

Hadith No: 5

Yahya related to me from Malik from Ibn Shihab from Uthman ibn Ishaq ibn Kharasha that Qabisa ibn Dhu'ayb said, "A grandmother came to Abu Bakr as-Siddiq and asked him for her inheritance. Abu Bakr said to her, 'You have nothing in the Book of Allah, and I do not know that you have anything in the sunna of the Messenger of Allah, may Allah bless him and grant him peace. Go away therefore, until I have questioned the people.' (i.e.the Companions). He questioned the people, and al-Mughira ibn Shuba said, 'I was present with the Messenger of Allah, may Allah bless him and grant him peace, when he gave the grandmother a sixth.' Abu Bakr said, 'Was there anybody else with you?' Muhammad ibn Maslama al-Ansari stood up and said the like of what al-Mughira said. Abu Bakr as-Siddiq gave it to her. Then the other grandmother came to Umar ibn al-Khattab and asked him for her inheritance. He said to her, "You have nothing in the Book of Allah, and what has been decided is only for other than you, and I am not one to add to the fixed shares, other than that sixth. If there are two of you together, it is between you. If eitherof you is left alone with it, it is hers."
