Moa'wiyah the criminal

Hadith No: 1

Fatima bint Qais reported that Abu 'Amr b. Hafs divorced her absolutely when he was away from home, and he sent his agent to her with some barley. She was displeased with him and when he said:

I swear by Allah that you have no claim on us. she went to Allah's Messenger (s.a.w.a.) and mentioned that to him. He said: There is no maintenance due to you from him, and he commanded her to spend the 'Idda in the house of Umm Sharik, but then said: That is a woman whom my companions visit. So better spend this period in the house of Ibn Umm Maktum, for he is a blind man and yon can put off your garments. And when the 'Idda is over, inform me. She said: When my period of 'Idda was over, I mentioned to him that Mu'awiya b. Abu Sufyan and Jahm had sent proposal of marriage to me, whereupon Allah's Messenger (s.a.w.a.) said: As for Abu Jahm, he does not put down his staff from his shoulder, and as for Mu'awiya, he is a poor man having no property; marry Usama b. Zaid. I objected to him, but he again said: Marry Usama; so I married him. Allah blessed there in and I was envied (by others).

Her statement: (So when I was free to marry, I mentioned to him that Muawiyah ibn Abi Sufyan and Abu al-Jahm had proposed to me): This is a clear indication that the Muawiyah who was proposing in this hadith is Muawiyah ibn Abi Sufyan ibn Harb, which is correct. It was also said that he is another Muawiyah, but this is a clear mistake that I have pointed out so as not to be misled by it, and I have clarified it in Tabhith al-Asma wa al-Lughat in the entry on Muawiyah. And Allah knows best.

26782 - He said: I read to Abd al-Rahman ibn Mahdi: Malik, from Abdullah ibn Yazid, freedman of al-Aswad ibn Sufyan, from Abi Salamah ibn Abd al-Rahman, from Fatimah bint Qays that Abu Umrah ibn Hafs divorced her irrevocably while he was absent, so he sent his agent to her with barley, and she despised it. He said: "By Allah, you have no claim against us." So she came to the Messenger of Allah (peace be upon him and his holy progeny) and mentioned that to him. He said: "You have no maintenance from him," and he commanded her to observe her waiting period in the house of Umm Sharik. Then he said: "That is a woman whom my companions will visit." So, perform your waiting period at the house of Ibn Umm Maktum, for he is a blind man. You can place your clothes there, and when you are free to remarry, notify me." When she was free, she mentioned to him that Muawiyah ibn Abi Sufyan and Abu al-Jahm were both proposing marriage to her. The Messenger of Allah (peace be upon him and his holy progeny) said: "As for Abu al-Jahm, he does not set down his staff," and as for Muawiyah, he is a good-for-nothing with no money. "Marry Osamah ibn Zayd."
