Hadith No: 1
Ibn Shabah al-Namiri - Tarikh al-Madinah - The Establishment of Umar (ra) of Punishments on the Near and Far

- Muhammad ibn al-Fadl Aram narrated to us, saying: Abdullah ibn al-Mubarak narrated to us, from Ma'mar, from al-Zuhri, who said: Abdullah ibn Amir ibn Rabiah narrated to me, and his father had witnessed the Battle of Badr, that Umar ibn al-Khattab (ra) appointed Qudamah ibn Muzdahin over Bahrain. Then al-Jarud, the chief of Abd al-Qays, came to Umar (ra) from Bahrain and said: "Qudamah ibn Muzdahin drank and became drunk, and I saw it as a necessary punishment that I should report it to you." Umar (ra) asked, "Who will testify with you?" He replied, "Abu Huraira (ra)." So he sent for Abu Huraira (ra), who said: "Will you testify?" Abu Huraira (ra) replied, "I did not see him when he drank, but I saw him drunk and vomiting..."

- Shahab ibn Ubad narrated to us, saying: Ibrahim ibn Humayd narrated to us, from Isma'il ibn Abi Khalid, from Mundhir ibn Abi al-Ashars, that when Umar (ra) struck Qudamah ibn Muzdun, he fell unconscious for sixty-five minutes. Then Umar (ra) said: "If he dies, I would whip him again with the remainder of the lashes on his grave."

- Mas'ud ibn Wasil narrated to us, who said: Hisham ibn Hasan narrated to us from Muhammad that al-Jarud came to Umar (may Allah be pleased with him) and said: "Indeed, Qudamah ibn Muz'un has drunk alcohol." Umar asked, "Who are your witnesses?" He replied, "Abu Huraira." Umar said, "By Allah, your brother-in-law I will surely strike him on the back with a whip." Al-Jarud replied, "By Allah, this is indeed injustice! Your brother-in-law drinks, and you strike my brother-in-law?" Umar said, "Who says this?" Alqamah said, "Bring them." So they came, and Umar said to Abu Huraira (may Allah be pleased with him): "What do you say?" He replied, "I bear witness that I saw him drinking it with Ibn Zubaira until it was fully consumed in his stomach." Then he said to Alqamah: "What do you say?" He replied, "Is the testimony of a eunuch permissible?" Umar said, "Bring it." Alqamah said, "Is the testimony of a eunuch permissible?" Umar said, "Bring it." Alqamah said, "Is the testimony of a eunuch permissible?" Umar said, "Bring it." Alqamah said, "I did not see him drinking it, but I saw him spitting it out." Umar said, "He did not spit it out until he had drunk it. Except for him, I do not see anyone else in our jurisdiction." Then he ordered him to be punished.

- Muhammad ibn Abbad ibn Musa al-Akli narrated to us, from Hishaim, from al-Mughira, from al-Sha'bi and others: that al-Jarud struck Qudamah ibn Muz'un al-Jumahi in Bahrain with a punishment for drinking alcohol while he was their governor. When Umar (ra) heard of this, he sent for them, and they stood before him. He said to al-Jarud: "Hey, did you dare to act against my son-in-law and the uncle of my children?" Al-Jarud replied: "I would not dare to act against a Qurashi after you." Umar (ra) said: "I will strike your son's-in-law," meaning Abu Huraira. Al-Jarud said: "Is your son-in-law allowed to drink while my son-in-law is punished?" Umar (ra) replied: "That is not just." Then he said: "Bring your evidence." So he brought Abu Huraira (ra), who testified, and he brought Alqamah the eunuch, who testified that he saw him vomit it. Umar (ra) said: "He did not vomit it until he drank it." Umar (ra) delayed punishing Qudamah for a while due to an illness he had, then he called him and struck him with a punishment, saying: "By Allah, I will never speak to you again." Qudamah then saw a vision and came to him, speaking, and said: "I have not favored anyone since you appointed me over a man other than him, and I have not been blessed in it."

- Muhammad ibn Sinan narrated to us, who said: Sharik narrated to us, from al-Mughira, from al-Sha'bi, who said: Umar (may Allah be pleased with him) appointed Qudama over some of his affairs, and he drank wine. Then al-Jarud stood up to him and flogged him with a hadd punishment while he was drunk and unconscious. This was reported to Umar (may Allah be pleased with him), and he sent for him and said: "Did you strike the uncle of my child and humiliate him?" He replied: "The whips fell on his back, and he did not know." Umar (may Allah be pleased with him) said: "Bring me witnesses to what you say, or I will punish you." He said: "I call upon Allah to witness that there was a man who saw it when he stood up." Then a man stood up and said: "I will testify if you accept the testimony of a eunuch." Umar replied: "As for you, I will accept your testimony." The man continued: "I testify that I saw him vomiting wine." Umar said: "Whoever vomits it has certainly consumed it." Al-Sha'bi said: "No one should be punished while drunk until they are sober, except an imam, for when he sobers up, he will be able to refuse."

- Muhammad ibn Yahya narrated to us from Muhammad ibn Jaafar, who said: When al-'Ala ibn al-Hadhrami, the governor of Bahrain for Umar (ra), passed away, Umar (ra) appointed Qudamah ibn Muz'un as his successor. He set out to campaign against some lands of the Persians and encountered difficulties and excuses on their journey. They passed by an open house, and Qudamah, al-Arqam ibn Abi al-Arqam, Uyayesh ibn Abi Rabiyah al-Makhzumi, and Ibn Hanzhalah al-Ruzqi al-Ansari entered it. They found abundant food and wine in jars, so Qudamah and some of those with him ate and drank from the wine. Then Abu Hurayrah (ra) caught up with them, passed by the house, and entered it. He found them and disapproved of what they had done. He said, "What business do you have with this, O son of his father?" Uyayesh replied, "By Allah, I was not in a position to influence their actions, nor did I drink what they drank." Umar (ra) then asked, "What is your reason for being with them?" He replied, "I found shade in their presence and scooped up a piece of bread, eating it and drinking water with it." Al-Jarud al-Abdali and a man from the clan of Bani Rabah ibn Yarbou', ibn Hanzhalah, who was a eunuch in the time of ignorance and was called the Eunuch of Bani Rabah, went with a group of people from Bahrain until they arrived before Umar (ra). They mentioned Qudamah's situation and testified against him for drinking wine. Umar (ra) became angry with them and was greatly displeased, rebuking them and refusing to dismiss them, while also preventing others from doing so. Al-Jarud passed by Umar's (ra) house, where his daughter was looking out; she was Qudamah's niece. She said, "By Allah, I hope that Allah will humiliate you!" He replied, "Allah only humiliates the eyes that resemble yours or your father will sin." Umar (ra) hoped they would retract their testimonies, but the more they were confronted, the more intense their resolve became. He sent for them and listened to what they had to say, saying, "By Allah, I have never appointed a leader for personal desire, except for Qudamah. Then, by Allah, Allah did not bless me in him." Then he wrote to Abu Hurayrah (ra): "If what they testified is true, then punish Qudamah accordingly and be just." When Umar's letter came, Abu Hurayrah (ra) administered the punishment to Qudamah. Qudamah then came to Umar (ra) to complain about Abu Hurayrah, and Abu Hurayrah (ra) came forward. Umar (ra) sent for him and said, "Compete with Qudamah, for he has complained about you." He replied, "I will not do so until my mind is clear and the weariness of travel is gone from me. I have been deprived of sleep during my journey." He remained for three days, then competed with Qudamah in Umar's house, where Umar (ra) had Zaynab bint Muz'uun, the mother of Hafsah, and Abdullah, the sons of Umar, present. They exchanged arguments, and Abu Hurayrah (ra) was the most verbally adept among them. Zaynab bint Muz'uun became distressed and said, "May Allah curse you, O long-tongued old man, unjust!" Abu Hurayrah replied, "Indeed, may Allah curse you, O red, dusty old woman, with a foul tongue, who speaks immorally in her house!" Qudamah said, "O Commander of the Faithful, ask him why he punished me." He said, "I punished you for what I saw in you." Qudamah asked, "Did you see me drinking wine?" He replied, "No." Umar (ra) said, "Allah is the Greatest." Abu Hurayrah (ra) said, "May Allah have mercy on Abu Bakr! Your wife insults me, you judge between me and your son-in-law in your house, and you help me with your exclamations of disapproval." Umar (ra) said, "So stand up." They all stood until we sat in the mosque, and people gathered around them. Qudamah said, "I ask you by Allah, did you see me drinking wine?" He replied, "No." Qudamah continued, "Did you see me buying it?" He said, "No." Qudamah asked, "Did you see me carrying it?" He said, "No." Qudamah then inquired, "Did you see it being carried to me?" He said, "No." Qudamah exclaimed, "Allah is the Greatest! Then why did you punish me?" He answered, "I punished you because I saw you vomiting it, expelling it from your stomach. So, how did you ingest it?" Qudamah replied, "And you consider yourself knowledgeable about wine?" He said, "Yes, by Allah! I could drink it, but I did not drink it after I pledged allegiance to the Messenger of Allah (peace be upon him and his holy progeny)." Umar (ra) said, "Repent to Allah, O Qudamah! Allah speaks the truth, and you lie, you show affection, and you act in excess. Repent to Allah." Ibn Jundab al-Hudhali came to him from Bahrain and he provided for him. When Umar (ra) struck him for drinking, Ibn Jundab said:
"I hope for good from Qudamah after he has been struck with the whip on every bone and joint.
You drank what is unlawful, O Qudamah, and sent upon you the whips of one who drinks wine from above."
"Do not drink wine, Qudamah, for it is *forbidden to the People of the Book."
