Companion al-Waleed Ibn Uqba drinks wine after accepting Islam

Hadith No: 1

Narrated 'Ubaidullah bin `Adi bin Al-Khiyar:

Al-Miswar bin Makhrama and `Abdur-Rahman bin Al-Aswad bin 'Abu Yaghuth said (to me), "What forbids you to talk to `Uthman about his brother Al-Walid because people have talked much about him?" So I went to `Uthman and when he went out for prayer I said (to him), "I have something to say to you and it is a piece of advice for you " `Uthman said, "O man, from you." (`Umar said: I see that he said, "I seek Refuge with Allah from you.") So I left him and went to them. Then the messenger of `Uthman came and I went to him (i.e. `Uthman), `Uthman asked, "What is your advice?" I replied, "Allah sent Muhammad with the Truth, and revealed the Divine Book (i.e. Qur'an) to him; and you were amongst those who followed Allah and His Apostle, and you participated in the two migrations (to Ethiopia and to Medina) and enjoyed the company of Allah's Messenger (s.a.w.a.) and saw his way. No doubt, the people are talking much about Al-Walid." `Uthman said, "Did you receive your knowledge directly from Allah's Messenger (s.a.w.a.) ?" I said, "No, but his knowledge did reach me and it reached (even) to a virgin in her seclusion." `Uthman said, "And then Allah sent Muhammad with the Truth and I was amongst those who followed Allah and His Apostle and I believed in what ever he (i.e. the Prophet) was sent with, and participated in two migrations, as you have said, and I enjoyed the company of Allah's Messenger (s.a.w.a.) and gave the pledge of allegiance him. By Allah! I never disobeyed him, nor did I cheat him till Allah took him unto Him. Then I treated Abu Bakr and then `Umar similarly and then I was made Caliph. So, don't I have rights similar to theirs?" I said, "Yes." He said, "Then what are these talks reaching me from you people? Now, concerning what you mentioned about the question of Al-Walid, Allah willing, I shall deal with him according to what is right." Then he called `Ali and ordered him to flog him, and `Ali flogged him (i.e. Al-Walid) eighty lashes.

Narrated 'Ubaidullah bin `Adi bin Al-Khiyar:

That Al-Miswar bin Makhrama and `Abdur-Rahman bin Al-Aswad bin 'Abu Yaghuth had said to him, "What prevents you from speaking to your uncle `Uthman regarding his brother Al-Walid bin `Uqba?" The people were speaking against the latter for what he had done. 'Ubaidullah said, "So I kept waiting for `Uthman, and when he went out for the prayer, I said to him, 'I have got something to say to you as a piece of advice.' `Uthman said, 'O man! I seek Refuge with Allah from you. So I went away. When I finished my prayer, I sat with Al-Miswar and Ibn 'Abu Yaghutb and talked to both of them of what I had said to `Uthman and what he had said to me. They said, 'You have done your duty.' So while I was sitting with them. `Uthman's Messenger came to me. They said, 'Allah has put you to trial." I set out and when I reached `Uthman, he said, 'What is your advice which you mentioned a while ago?' I recited Tashahhud and added, 'Allah has sent Muhammad and has revealed the Holy Book (i.e. Qur'an) to him. You (O `Uthman!) were amongst those who responded to the call of Allah and His Apostle and had faith in him. And you took part in the first two migrations (to Ethiopia and to Medina), and you enjoyed the company of Allah's Messenger (s.a.w.a.) and learned his traditions and advice. Now the people are talking much about Al-Walid bin `Uqba and so it is your duty to impose on him the legal punishment.' `Uthman then said to me, 'O my nephew! Did you ever meet Allah's Messenger (s.a.w.a.) ?' I said, 'No, but his knowledge has reached me as it has reached the virgin in her seclusion.' `Uthman then recited Tashahhud and said, 'No doubt, Allah has sent Muhammad with the Truth and has revealed to him His Holy Book (i.e. Qur'an) and I was amongst those who responded to the call of Allah and His Apostle and I had faith in Muhammad's Mission, and I had performed the first two migrations as you have said, and I enjoyed the company of Allah's Messenger (s.a.w.a.) and gave the pledge of allegiance to him. By Allah, I never disobeyed him and never cheated him till Allah caused him to die. Then Allah made Abu Bakr Caliph, and by Allah, I was never disobedient to him, nor did I cheat him. Then `Umar became Caliph, and by Allah, I was never disobedient to him, nor did I cheat him. Then I became Caliph. Have I not then the same rights over you as they had over me?' I replied in the affirmative. `Uthman further said, 'The what are these talks which are reaching me from you? As for what you ha mentioned about Al-Walid bin 'Uqba; Allah willing, I shall give him the leg; punishment justly. Then `Uthman ordered that Al-Walid be flogged fort lashes. He ordered `Ali to flog him an he himself flogged him as well."

Hadith No: 3

Hudhain b. al-Mundhir Abu Sasan reported:

I saw that Walid was brought to Uthmin b. 'Affan as he had prayed two rak'ahs of the dawn prayer, and then he said: I make an increase for you. And two men bore witness against him. One of them was Humran who said that he had drunk wine. The second one gave witness that he had seen him vomiting. Uthman said: He would not have vomited (wine) unless he had drunk it. He said: 'Ali, stand up and lash him. 'Ali said: Hasan, stand up and lash him. Thereupon Hasan said: Let him suffer the heat (of Caliphate) who has enjoyed its coolness. ('Ali felt annoyed at this remark) and he said: 'Abdullah b. Ja'far, stand up and flog him, and he began to flog him and 'Ali counted the stripes until these were forty. He (Hazrat 'Ali) said: Stop now, and then said: Allah's Apostle (S) gave forty stripes, and Abu Bakr also gave forty stripes, and Umar gave eighty stripes, and all these fall under the category of the Sunnab, but this one (forty stripes) is dearer to me.

- .... And Abd al-Razzaq narrated from Alqamah who said: The commander of the army, namely al-Walid ibn Uqbah, stumbled upon a drink and became intoxicated. The people said to Ibn Mas'ud and Hudhayfah ibn al-Yaman: "Shall you not impose the hadd (legal punishment) on him?" They replied: "No, we will not do that. We are in the face of the enemy and dislike that they know, as it would be a show of bravado from them towards us and a weakness on our part." And in al-Ma'alim, it is said that al-Awza'i stated, "The commander of the army should not be punished until he returns from the expedition. Once he returns, he may be punished."

1184 - Muhammad ibn Ja'far narrated to us, saying: Sa'id narrated to us, from Abd Allah al-Danaj, from Hadhin, who said: I witnessed against al-Walid ibn Uqbah before Uthman that he had drunk alcohol, and Ali spoke to Uthman about him, saying: "Your cousin is before you, so punish him." Uthman replied: "Get up, Hasan." Ali said: "What do you have to do with this? This position should be handled by someone other than you." Uthman responded: "Rather, I am unable, weakened, and weary. Get up, Abd Allah ibn Ja'far," so he punished him, and Ali (ra) counted. When the punishment reached forty, Uthman said: "That is enough" or "Hold on," The Messenger of Allah (peace be upon him and his holy progeny) punished him with forty, Abu Bakr with forty, and Umar completed it with eighty, each year.

1230 - Yazid ibn Harun narrated to us, saying: Sa'id ibn Abi Urooba narrated to us, from Abdullah al-Danaj, from Huzain ibn al-Mundhir ibn al-Harith ibn Wa'la: that al-Walid ibn Uqba prayed the Fajr prayer with the people four rak'ahs, then turned to them and said: "Should I give you more?" This was reported to Uthman, and he ordered that he be whipped. Then Ali said to al-Hasan ibn Ali: "Stand up, O Hasan, and whip him." Al-Hasan replied, "What will you do while that is happening?" Ali said: "Rather, you are incapable and weak. Stand up, O Abdullah ibn Ja'far, and whip him." So Abdullah ibn Ja'far stood up and whipped him, while Ali counted. When he reached forty, he said: "Stop," then he said: "The Messenger of Allah (peace be upon him and his holy progeny) struck for drinking alcohol forty, and Abu Bakr struck forty, and Umar struck for a time during his caliphate, then Umar completed it to eighty, each year."

Hadith No: 7

Narrated Sa'd:

On the day when Mecca was conquered, the Messenger of Allah (S) gave protection to the People except four men and two women and he named them. Ibn AbuSarh was one of them.

He then narrated the tradition. He said: Ibn AbuSarh hid himself with Uthman ibn Affan. When the Messenger of Allah (S) called the people to take the oath of allegiance, he brought him and made him stand before the Messenger of Allah (S). He said: Messenger of Allah, receive the oath of allegiance from him. He raised his head and looked at him thrice, denying him every time. After the third time he received his oath. He then turned to his Companions and said: Is not there any intelligent man among you who would stand to this (man) when he saw me desisting from receiving the oath of allegiance, and kill him? They replied: We do not know, Messenger of Allah, what lies in your heart; did you not give us an hint with your eye? He said: It is not proper for a Prophet to have a treacherous eye.

Abu Dawud said: 'Abd Allah (b. Abi Sarh) was the foster brother of 'Uthman, and Walid b. 'Uqbah was his brother by mother, and 'Uthman inflicted on him hadd punishment when he drank wine.

- .... Abu Mukhnaf mentioned a man named Lut, but his narration is weak, from his uncle al-Su'iq ibn Zuhayr who reported from Muhammad ibn Mukhnaf, who said: He was one of the first governors of Uthman, appointed the youngest al-Walid ibn Uqbah. He would summon sorcerers and drink alcohol, and he would be in the company of Abu Zubaid al-Ta'i, a Christian. Then a sorcerer from the people of Babylon came and started showing them a rope in the mosque that appeared to stretch infinitely, with an elephant walking on it and a she-camel running, while the people marvelled. Then he showed them a rope that seemed to tighten until it entered his mouth and came out of his rear. He would then strike the head of a man, and he would fall to the side, and say, "Get up," and the man would stand. When Jundub ibn Ka'b saw this, he took a sword and struck the sorcerer's neck, saying, "Revive yourself!" al-Walid ordered him to be killed, but men from al-Azd stood up and prevented him, saying, "Shall we kill him for a lowly sorcerer?" So he imprisoned him and narrated the story in full.

8197 - Ali ibn Muhammad ibn Uqbah al-Shaybani narrated to us in Kufa, saying: Muhammad ibn Ali ibn Uffan al-Amiri narrated to us, saying: Asbat ibn Muhammad al-Qurashi narrated to us, saying: al-A'mash narrated from Zayd ibn Wahb, who said: A man went to Abdullah ibn Mas'ud (may Allah be pleased with him) and said: "Do you not see in al-Walid ibn Uqbah, with his beard dripping with wine?" Ibn Mas'ud replied: "Indeed, the Messenger of Allah (peace be upon him and his holy progeny) forbade us from spying. If he shows himself to us, we will take action." This is a narration with a sound chain of transmission, and they did not include it in their works.

17529 - Abu Bakr Muhammad ibn al-Hasan ibn Furk narrated to us, saying: Abdullah ibn Ja'far ibn Ahmad ibn Faris narrated to me, saying: Yunus ibn Habib narrated to us, from Abu Dawud, from Abdulaziz ibn al-Mukhtar, from Abdullah ibn Firuz from Huzayn ibn Abu Sasan al-Ruqashi, who said: "I witnessed Uthman ibn Affan (may Allah be pleased with him) when he came to al-Walid ibn Uqbah, who had drunk wine, and Hurmuz ibn Aban and another man bore witness against him." Uthman said to Ali (may Allah be pleased with them both): "Administer the punishment to him." Ali (may Allah be pleased with him) instructed Abdullah ibn Ja'far Dhul-Janahayn (may Allah be pleased with him) to flog him, and he began to flog him while Ali (may Allah be pleased with him) counted, until he had given him forty lashes. Then he said to him: "Stop! The Messenger of Allah (peace be upon him and his holy progeny) flogged forty, and Abu Bakr (may Allah be pleased with him) and Umar (may Allah be pleased with him) each flogged eighty, and this is preferable." Muslim narrated this in his Sahih from the narration of Abdulaziz ibn al-Mukhtar.

17530 - Abu Muhammad Abdullah ibn Yusuf al-Isbahani narrated to us, saying: Abu Sa'id ibn al-A'rabi narrated to us, saying: al-Hasan ibn Muhammad al-Za'farani narrated to us, from Abd al-Wahhab ibn Ata, from Sa'id, from Abdullah al-Danaj from Habin, the father of Sasan, who said: A group of them rode and came to Uthman ibn Affan (may Allah be pleased with him), and informed him of what al-Walid had done. So Uthman said to Ali ibn Abi Talib (may Allah be pleased with him): "Here is your cousin, execute the punishment on him." Ali said to al-Hasan (may Allah be pleased with him): "Stand up and carry out the punishment." Al-Hasan (may Allah be pleased with him) replied: "What is the matter between you and this? This does not concern you, but someone else." Ali said: "Rather, you are unable, weakened, and feeble." Abdullah ibn Ja'far, stand up and punish him." So he began to punish him, and Ali (may Allah be pleased with him) was counting until he reached forty. Then he said: "Stop! The Messenger of Allah (peace be upon him and his holy progeny) punished with forty lashes, and Abu Bakr punished with forty, and Umar punished with eighty, and this is the practice for each year."

17531 - Abu Muhammad narrated to us, who said: Abu Sa'id narrated to us, who said: al-Za'farani narrated to us, who said: Yazid ibn Harun narrated to us, who said: Sa'id narrated to us from Abdullah al-Danajj from Huzayn ibn Mundhir ibn al-Harith ibn Wa'ilah, that al-Walid ibn Uqbah led the people in the Fajr prayer, praying four rak'ahs, then turned to them and said: "Shall I add more?" This was reported to Uthman (may Allah be pleased with him) - and he mentioned something similar, except that in Yazid's narrative, it states that the Messenger of Allah (peace be upon him and his holy progeny) struck (with lashes) forty times, and Abu Bakr and Umar (may Allah be pleased with them) did so for a time during their caliphates, then Umar completed it to eighty, and each year. Muslim reported this in the Sahih from the narration of Ibn Aliyyah, from Sa'id ibn Abi 'Ubaybah, in a summarized form.

The people said to Abu Mas'ud and Hudhayfah ibn al-Yaman: "Shall we impose the punishment on him?" They both replied: "No, we will not do so. We are in the presence of the enemy, and we dislike them to know, as it would show boldness on their part towards us and weakness on ours."

3151 - Isaac ibn Ibrahim al-Dabari narrated to us, from Abd al-Razzaq, from Ibn al-Taymi, who said: Sulayman ibn al-Mughira narrated to me, from Humaid ibn Hilal, from Abdullah ibn al-Samit, who said: Al-Hakam ibn Amr al-Ghifari led the people in prayer while on a journey, with a screen set up in front of him. Camels passed between him and his companions, and he repeated the prayer with them. They said: He wanted to do as al-Walid ibn Uqba did when he prayed four rak'ahs with his companions in the morning and then said, 'Shall I give you more?' So, they caught up with al-Hakam and mentioned this to him, and he waited until the people gathered. Then he said: "I repeated the prayer with you because of the camels that passed between you." You portrayed me as an example of Ibn Abi Mu'ayt, and I ask Allah to improve your conduct and the conduct of Iraq, to grant you victory over your enemy, and to make a distinction between me and you." They departed, and nothing was seen on their faces except what they were pleased with. When he finished, he died.

So al-Walid and Abdullah ibn Sa'd repeated their statement and said: "Prevent them from water until night, for if they are unable to get it, they will retreat, and their retreat will be a defeat. Keep them from water; may God prevent them from it on the Day of Resurrection." Sa'sa'a said: "God only prevents it from the wicked and those who drink wine. May God curse you and curse this transgressor," referring to al-Walid ibn Uqbah. So they cursed him and threatened him.

- .... And from Abu al-Darda, a similar statement And from Alqamah, who said: We were in an army in the land of the Romans, and with us was Hudhayfah ibn al-Yaman, and over us was al-Walid ibn Uqbah. He drank wine, and we intended to admonish him, but Hudhayfah said: "Will you challenge your commander when you are close to your enemies, and they might become emboldened against you?"
