- It is said that Aws ibn Sharhabil's narration from the Prophet (peace be upon him and his holy progeny) regarding someone who drinks alcohol is similar to Muawiyah's narration: "If he returns for the fourth time, kill him," and this is abrogated by consensus and by his (peace be upon him and his holy progeny) saying: "The blood of a Muslim person is not permissible to shed except in one of three cases," and by flogging, with either Naiman or the son of Naiman, as a fifth in the case of alcohol. Even if his narration is marfu', it is supported by consensus.

Chapter on al-Nu'man - 2622: al-Nu'man ibn Amr ibn Rafi'a ibn Suwad

2622 - al-Nu'man ibn Amr ibn Rafi'a ibn Suwad, also said to be Rafi'a ibn al-Harith ibn Suwad ibn Malik ibn Ghanam ibn Malik ibn al-Jar, witnessed the Battle of Badr. He was known as Nu'ayman and witnessed the last Pledge of Aqabah, and he is regarded as one of the seventy there in the opinion of Ibn Ishaq. He witnessed Badr and all the battles with the Messenger of Allah (peace be upon him and his holy progeny). Al-Waqidi said: Nu'ayman remained until he died during the caliphate of Mu'awiyah. Abu Umar said: I think he was a companion of Abu Bakr and Suwaybit (may Allah be pleased with them both) and I believe he is the one who was flogged for drinking alcohol more than five times.

2659 - Nu'ayman ibn Amr ibn Rifa'ah ibn al-Harith ibn Suwad ibn Malik ibn Ghanm ibn Malik ibn al-Najjar: He witnessed the Battle of Badr and was one of the early companions and their prominent figures. He had an exuberant sense of humor and there are charming anecdotes about his playful nature, including his story with Suwaybt ibn Harmalah.... Al-Zubayr said, and Yahya ibn Muhammad narrated to me, saying: Ya'qub ibn Ja'far ibn Abi Kathir narrated to me, saying: Abu Tawalah al-Ansari narrated from Muhammad ibn Amr ibn Hazm from his father, who said: There was a man in Medina named Nu'ayman who would indulge in drink. He would be brought to the Prophet (peace be upon him and his holy progeny), and he would strike him with his sandal and instruct his companions to strike him with their sandals and sprinkle dirt on him. When this became frequent for him, a man from the companions of the Prophet (peace be upon him and his holy progeny) said to him, "May Allah curse you!" The Messenger of Allah (peace be upon him and his holy progeny) replied, "Do not do that, for he loves Allah and His Messenger...." Abu Umar said: Nu'ayman was a righteous man despite his playful nature. He had a son who became deeply immersed in drinking alcohol, and the Messenger of Allah (peace be upon him and his holy progeny) punished him with lashes four times. A man present with the Messenger of Allah (peace be upon him and his holy progeny) cursed him, and the Messenger of Allah (peace be upon him and his holy progeny) said to him, "Do not curse him, for he loves Allah and His Messenger." The four lashes from the Messenger of Allah (peace be upon him and his holy progeny) in response to his drinking were an abrogation of his saying, peace be upon him and his holy progeny, "If he drinks it the fourth time, kill him." It is said that he died in the time of Muawiyah, while others say it was his son who died in the time of Muawiyah....
