- Al-Nu'man ibn Amr ibn Rifa'a ibn al-Harr: he witnessed the Battle of Badr and the battles that followed. It is also said that he was the one who would be brought to him in a state of intoxication and a man said, "May God curse him, how often he is brought here!" The Messenger of God (peace be upon him) replied, "Do not curse him, for he loves God and His Messenger."

164 - Muhammad ibn Humayd al-Abdi narrated to us, from Mu'mar ibn Rashid from Zayd ibn Aslam, who said: al-Nu'man was brought to the Prophet (peace be upon him and his holy progeny), and he was flogged. Then he was brought again and flogged, and then he was brought again and flogged. He said, "several times or five," referring to his drinking of nabidh. Then a man said, "O Allah, curse him! How much he drinks and how often he is flogged!" The Prophet (peace be upon him and his holy progeny) said, "Do not curse him, for he loves Allah and His Messenger...."

10675 - And from Jabir ibn Abdullah: That the Messenger of Allah (peace be upon him and his holy progeny) said: "Whoever drinks alcohol, flog him. If he returns (to it), flog him. If he returns, flog him. If he returns for the fourth time, kill him." He said: Then al-Nu'man was brought (to him) who had drunk (alcohol) for the fourth time, and he flogged him but did not kill him. So this was considered abrogating the command to kill - I say, Al-Tirmidhi narrated it, except for his statement that this was abrogating the command to kill, and the naming of al-Nu'man was narrated by al-Bazzar.

- .... And Jubair narrated many hadiths from the Messenger of Allah (peace be upon him and his holy progeny). Among them was Uqbah ibn al-Harith ibn Amir ibn Naufal ibn Abd Manaf ibn Qusai. Uqbah narrated from the Prophet (peace be upon him and his holy progeny). Ibn Bashar told us, saying: Abdul Wahhab narrated to us, saying: Ayyub narrated to us from Abdullah ibn Abi Muliaka from Uqbah ibn al-Harith, who said: "An-Nu'man or the son of an-Nu'man was brought, drinking, and the Messenger of Allah (peace be upon him and his holy progeny) commanded those in the house to strike him." He said: So I was among those who struck him, and we struck him with sandals and palm fronds.

He said, "And I was among those who beat him, and we beat him with sandals and palm fronds."

Al-Shafi'i said that the execution is abrogated by this hadith and others, and this is something upon which there is no disagreement among the scholars. I understood that he meant the hadith of Qabeesah ibn Thuwayb, which states that the punishment of execution was thus a concession ....

- My grandfather narrated to me, saying: Hafs ibn Umar narrated to us, saying: Thawr narrated to us, from Makhrul, from Qabisa ibn Dhuwyayb from Zayd ibn Thabit that the Prophet, peace be upon him and his holy progeny, flogged al-Nu'man four times for drinking alcohol. Zayd said: Thus, his initial statement was abrogated, and he had commanded, saying: "If he drinks it a fourth time, kill him."

Then a man from the crowd said: "O Allah, curse him! How much he drinks and how often he is punished!" The Prophet (peace be upon him and his holy progeny) replied: "Do not curse him, for he loves Allah and His Messenger," and perhaps this explanation should not be interpreted too literally.

- .... Al-Khattabi and others said: what is meant is the past, not the future, because if it were the future, it would be an expression of absolution in sins, and there is no justification for it. And the Prophet (peace be upon him) had Na'imaan punished for drinking wine, and Umar (may Allah be pleased with him) also punished Qudamah ibn Maz'un for it, both of whom were among the Ansar present at the Battle of Badr. And the Prophet (peace be upon him) imposed a punishment on Mistah, who was also a Badr participant. (In this regard, all of the mentioned) previous (sins) are equal, meaning any sin of drinking or otherwise.
