Chapter on Those Who Claim That Punishments Are Not to Be Carried Out in the Land of War Until They Return

- Abu Abdullah al-Hafiz and Abu Bakr Ahmad ibn al-Hasan al-Qadi both said: Abu al-Abbas Muhammad ibn Ya'qub narrated to us, saying: Muhammad ibn Ishaq narrated to us, saying: Ishaq ibn Ibrahim al-Razi, the brother-in-law of Salamah ibn al-Fadl al-Ansari, narrated to us, saying: Salamah narrated to me, from Muhammad ibn Ishaq, from Abdul-Rahman ibn al-Harith ibn Abdullah ibn Uyayash ibn Abi Rabi'ah, from Abdullah ibn Urwah al-Zubayr, from his father
and from Yahya ibn Urwah ibn al-Zubayr, from his father, who said: Abdul ibn al-Azwar, Dharr ibn al-Azwar, and Abu Jandal ibn Suhail ibn Amr were drinking in Shaam, and they were brought to Abu Ubaydah ibn al-Jarrah (may Allah be pleased with him). Abu Jandal said: By Allah, I did not drink it except with the interpretation that I heard Allah say: {There is no blame upon those who believe and do righteous deeds for what they have eaten, if they fear Allah and believe and do righteous deeds} (Surah al-Ma'idah 5:93). So Abu Ubaydah wrote to Umar (may Allah be pleased with him) about their situation, and Abdul ibn al-Azwar said: Our enemy is now present, so if you see fit to delay us until we meet our enemy tomorrow, then Allah has honored us with martyrdom, that will be enough for you, and you would not be exposing us to disgrace by having us return. If you look to what your companion instructed you, and you carry it out, Abu Ubaydah (may Allah be pleased with him) said: Yes. So when the people met, Abdul ibn al-Azwar was killed, a martyr. The letter returned to Umar (may Allah be pleased with him):
"Indeed, what led Abu Jandal to fall into sin has been prepared for him within reason." When this reaches you, impose upon them their punishment, and peace." Abu Ubaydah (may Allah be pleased with him) then called them both and punished them, while Abu Jandal had some honor and his father's status. He would contemplate until it was said that he was whispering to himself. Abu Ubaydah wrote to Umar (may Allah be pleased with him): "As for what follows, I have punished Abu Jandal, and he has begun to think to himself, to the point that we fear he may perish." Umar (may Allah be pleased with him) wrote to Abu Jandal: "As for what follows, indeed, what led you to sin is saddened by your repentance: {Ham. A revelation of the Book from Allah, the Mighty, the All-Knowing. Forgiver of sin and Accepting of repentance, Severe in punishment, the Possessor of abounding goodness. There is no deity except Him; to Him is the ultimate return} (Surah Ghafir 40:1-3)." When he read Umar's letter (may Allah be pleased with him), what was upon him departed, as if he had been released from a restraint.
