14113 - As for what was narrated from Jabir about Umar ibn al-Khattab that he addressed the people and said: "There were two temporary practices during the time of the Messenger of Allah (peace be upon him and his holy progeny), and I am forbidding them or punishing for them": one of them is the temporary marriage of women, and I cannot bear to see a man who marries a woman for a specified time except that I stone him, and the other is the temporary marriage of pilgrimage. Separate your Hajj from your Umrah, for it is more complete for your Hajj and more complete for your Umrah.

8878 - Abu Bakr ibn Furk informed us, saying: Abdullah ibn Ja'far narrated to us, Younus ibn Habib narrated to us, Abu Dawud narrated to us, Shu'bah narrated to us from Qatadah, who said: I heard Abu Busra say: I said to Jabir ibn Abdullah: "Ibn az-Zubair is forbidding mut'ah (temporary marriage), while Ibn Abbas is commanding it." Jabir replied: "On my hands, the legacy of the Hadith was fulfilled, and we engaged in mut'ah during the time of the Messenger of Allah (peace be upon him and his holy progeny). But when Umar (may Allah be pleased with him) addressed the people, he said: 'Indeed, Allah, the Almighty, used to permit His Prophet (peace be upon him and his holy progeny) to do as He willed, and the Qur'an has now established its rulings. Therefore, separate your Hajj from your Umrah, and uphold the marriages with these women. I will not tolerate a man who marries a woman for a specified time except that I will stone him.'" This was narrated by Muslim in his Sahih from the narration of Gundar via Shu'bah, and it was also narrated by Hammam from Qatadah, who added in the narration: "for this completes your Hajj and perfects your Umrah," indicating that the prohibition on the enjoyment (mut'ah) of Hajj was in the manner clarified in the preceding hadith.

14146 - Abu Muhammad Abdullah ibn Yusuf al-Isbahani narrated to us, saying: Abu Sa'id Ahmad ibn Muhammad ibn Ziyad al-Basri informed me in Mecca, saying: Al-Hasan ibn Muhammad al-Za'farani narrated to us, saying: Sufyan ibn Uyayna narrated to us from al-Zuhri from al-Hasan ibn Muhammad and Abdullah ibn Muhammad, from their father, that Ali (may Allah be pleased with him) said: "He is a wandering man. Do you not know that Messenger of Allah (peace be upon him and his holy progeny) forbade mut'ah and the flesh of domesticated donkeys?" This was narrated by al-Bukhari in the Sahih from Malik ibn Isma'il from Ibn Uyayna, who added at the end of the hadith: during the time of Khaybar. And Muslim narrated it from a group from Ibn Uyayna, and Ibn Uyayna's reports in al-Humaydi's narration from him indicate that this timeframe pertains only to the prohibition on the flesh of domesticated donkeys, not the prohibition on mut'ah marriage.

14170 - Muhammad ibn Abdullah al-Hafiz narrated to us, saying: Abdullah ibn Muhammad ibn Musa narrated to us, saying: Muhammad ibn Ayyub narrated to us, saying: Musa ibn Isma'il narrated to us, from Hammad, from Qatadah, from Abu Nadrah from Jabir (may Allah be pleased with him) who said: I said, "Ibn Zubair forbids temporary marriage (mut'ah), while Ibn Abbas permits it." He replied, "The matter unfolded before me; we engaged in temporary marriage (mut'ah) with the Messenger of Allah (peace be upon him and his holy progeny) and with Abu Bakr (may Allah be pleased with him). But when Umar took charge, he addressed the people and said: 'Indeed, the Messenger of Allah (peace be upon him and his holy progeny) is this messenger, and this Qur'an is this Qur'an, and they were both forms of temporary marriage (mut'ah) during the time of the Messenger of Allah (peace be upon him and his holy progeny). I am now forbidding them and will impose penalties for them.' One of them is the temporary marriage of women, and I cannot bear to see a man who marries a woman for a specified time except that I stone him.' The other is the temporary pilgrimage (Hajj), 'Separate your Hajj from your Umrah, for it is a more complete Hajj and a more complete Umrah.'" Muslim narrated it in his Sahih from another chain of transmission from Hammad. The Sheikh said: And we do not doubt that it was practiced during the time of the Messenger of Allah (peace be upon him and his holy progeny), but we found that he prohibited temporary marriage (Nikah al-Mut'ah) in the year of the Conquest after having permitted it, and we did not find him to have permitted it again after the prohibition until he passed away (peace be upon him and his holy progeny). Thus, Umar ibn al-Khattab's (may Allah be pleased with him) prohibition of temporary marriage (Nikah al-Mut'ah) was in accordance with the Sunnah of the Messenger of Allah (peace be upon him and his holy progeny), so we acted upon it. We did not find him (peace be upon him and his holy progeny) to have prohibited the temporary pilgrimage (Mut'at al-Hajj) in any authentic narration from him, and we found in Umar's (may Allah be pleased with him) statement an indication that he preferred to separate between Hajj and Umrah to make both more complete. Therefore, we interpreted his prohibition of the temporary pilgrimage as being one of discouragement and a preference for individual choice over other options, not as a prohibition of what is haram. And Allah is the Grantor of success.

14368 - Abu Abd Allah al-Hafiz narrated to us, saying: Abu al-Walid narrated to me, saying: Ibrahim ibn Abi Talib narrated to us, saying: Muhammad ibn Rafi narrated to us, saying: Abd al-Razzaq narrated to us, from Ibn Jurayj, who said: Abu al-Zubair informed me, saying: I heard Jabir ibn Abdullah (may Allah be pleased with him) say: "We used to enjoy (i.e., engage in temporary marriage) with a handful of dates for a few days during the time of the Messenger of Allah (peace be upon him and his holy progeny) and Abu Bakr, until 'Amr ibn Harith forbade us." Muslim narrated this in al-Sahih from Muhammad ibn Rafi, and it has been established that the Messenger of Allah (peace be upon him and his holy progeny) indicated that he prohibited the marriage of mut'ah (temporary marriage) after the initial allowance. The abrogation that occurred was only regarding the cancellation of the specified duration, not the amount they were permitted to marry with in terms of dowry. And Allah knows best.
