Khums in the source books of the Ahl al-Sunnah

Hadith No: 1

Narrated Jubair b. Mu'tim:

On the day of Khaibar the Messenger of Allah (s.a.w.a.) divided the portion to his relatives among the Banu Hashim and Banu 'Abd al-Muttalib, and omitted Banu Nawfal and Banu 'Abd Shams. So I and 'Utham b. 'Affan went to the Prophet (s.a.w.a.) and we said: Messenger of Allah, these are Banu Hashim whose superiority we do not deny because if the position in which Allah has placed you in relation to them ; but tell us about Banu 'Abd al-Muttalib to whom you have given something while omitting us though our relationship is the same as theirs. The Messenger of Allah (s.a.w.a.) said: There is no distinction between us and Banu 'Abd al-Muttalib in pre-Islamic days and in Islam. We and they are one, and he (s) intertwined his fingers.

Hadith No: 2

Sa'eed bin Al-Musayyab narrated that Jubair bin Mut'im told him:

"He and 'Uthman bin 'Affan came to the Messenger of Allah to speak to him about what he had distributed of the Khumus of Hunain to Banu Hashim and Banu Al-Muttalib bin 'Abd Manaf. They said: 'O Messenger of Allah, you distributed it to our brothers; Banu Al-Muttalib bin 'Abd Manaf, and you did not give us anything, and our relationship to you in the same as theirs. 'The Messenger of Allah said to them: 'I see that Hashim and Al-Muttalib are the same." Jubair bin Mut'im said: "The Messenger of Allah did not allocate anything to Banu 'Abd Shams or Banu Nawfal from that Khumus, as he allocated to Banu Hashim and Banu Al-Muttalib."

4428 - `Amr ibn Yahya ibn al-Harith narrated to us, saying: Mahbub narrated to us, saying: Abu Ishaq narrated to us, from Zaa'idah, from Abd al-Malik ibn Abi Sulayman from Ata in his statement: {And know that whatever of war booty you obtain, then indeed, it is for Allah and the Messenger, and for [his] near relatives, orphans, the needy, and the traveler, if you have believed in Allah and in that which We sent down to Our Servant on the day of criterion - the day when the two armies met. And Allah, over all things, is Competent} (Surah al-Anfal 8:41) said: "The share of Allah and the share of His Messenger are one. The Messenger of Allah (peace be upon him and his holy progeny) would carry from it, give from it, and place it wherever he wished, and do with it what he wanted."

4430 - Amr ibn Yahya narrated to us, who said: Mahbub narrated to us, who said: Abu Ishaq narrated to us, from Musa ibn Abi Aisha, who said: I asked Yahya ibn al-Jazzar about this verse: {And know that whatever of war booty you obtain, then indeed, it is for Allah and the Messenger and for [his] near relatives and the orphans, the needy, and the traveler, if you have believed in Allah and in that which We sent down to Our Servant on the day of criterion - the day when the two armies met. And Allah, over all things, is competent} (Surah Al-Anfal 8:41). He said: I asked how much of the khums was for the Prophet (peace be upon him and his holy progeny). He replied: One fifth of the one fifth.

Hadith No: 5

It was narrated from Sa’eed bin Musayyab that Jubair bin Mut’im told him that he and ‘Uthman bin ‘Affan came to the Messenger of Allah (s.a.w.a.) to speak to him about the way in which the one fifth from Khaibar had been distributed to Banu Hashim and Banu Muttalib. They said:

“You have distributed it to our brothers Banu Hashim and Banu Muttalib, but we are related to you (to Banu Hashim) in the same way (as Banu Muttalib).” The Messenger of Allah (s.a.w.a.) said: “Rather I think that Banu Hashim and Banu Muttalib are the same.”*

Ibn Abi Hatim said, My father narrated to us, saying, Ibn Mahdi al-Mis'i narrated to us, from al-Mu'tamir ibn Sulayman, from his father, from Hanzhalah, from Ikrimah from Ibn Abbas, who said: The Messenger of Allah (peace be upon him and his holy progeny) said: "I turned you away from the remnants of washing your hands because you have from the fifth of the fifth what will suffice you or be enough for you." This is a hadith with a good chain of narration. Ibrahim ibn Mahdi was trusted by Abu Hatim, and Yahya ibn Ma'in said, "He reports things that are munkar (strange)." And Allah knows best.

1781 - .... And because they are entitled to receive from the fifth of the fifth, they could not take from charity like the Banu Hashim. This is further emphasized by the narration that the Prophet (peace be upon him and his holy progeny) explained their prohibition from receiving alms by stating their self-sufficiency due to the fifth of the fifth when he said: "Is there not enough in the fifth of the fifth to suffice you?"

- .... Ibn Abi Hatim narrated from Ibn Abbas who said: "I have advised you against the washing of hands because you have in the fifth of the fifth what is sufficient for you or enriches you." Ibn Abi Hatim reported this from Ibrahim ibn Mahdi al-Mis'i who said: Al-Mu'tamir ibn Sulayman narrated to us from his father, from Hanj, from Ikrimah, from him, raised to the Prophet, peace be upon him and his holy progeny. Ibn Kathir said: "This is a hadith with a good chain of narration." Ibrahim ibn Mahdi was trusted by Abu Hatim, and Yahya ibn Ma'in said: "He narrates strange things."

- .... Ibn Marduyah narrated from Zayd ibn Arqam who said: "The people of Muhammad (peace be upon him and his holy progeny) who were given the fifth are the family of Ali, the family of Abbas, the family of Ja'far, and the family of Aqil."
- .... Ibn Marduyah narrated from Ibn Abbas who said: "The Prophet (peace be upon him and his holy progeny) had one thing from the gains that he would choose for himself, either a servant or a horse, and then he would receive from the fifth after that."
- .... Ibn Abi Shaybah and Ibn Marduyah narrated from Ali who said: "I said, O Messenger of Allah, will you not appoint me to what Allah has specially given us from the fifth?" He appointed me to it."
- .... Al-Hakim narrated and authenticated from him who said: "The Messenger of Allah (peace be upon him and his holy progeny) entrusted me with the fifth of the fifth, and I placed it in its rightful places during the lifetime of the Messenger of Allah (peace be upon him and his holy progeny), and of Abu Bakr and Umar."

- .... Ibn Ishaq and Ibn Abi Hatim narrated from al-Zuhri and Abdullah ibn Abi Bakr that the Prophet (peace be upon him and his holy progeny) distributed the share of those related by blood (Sahm Dhil-Qurba) from Khaybar among the Banu Hashim and Banu al-Muttalib.

Ibn Abi Shaybah narrated from Jubayr ibn Mut'am who said: The Messenger of Allah (peace be upon him and his holy progeny) divided the share of those related by blood (Sahm Dhil-Qurba) among the Banu Hashim and Banu al-Muttalib. He said, "I and Uthman ibn Affan walked until we entered upon him and he said: 'O Messenger of Allah, these are your brothers from Banu Hashim; we do not deny their virtue due to your position that Allah has placed you in among them. What do you think of our brothers from Banu al-Muttalib? You have given them something without us, even though we and they are in a similar position in terms of lineage.'" He replied, "They have not separated from us in ignorance (Jahiliyya) or Islam."
- .... Ibn Marduyah narrated from Zayd ibn Arqam who said: The family of Muhammad (peace be upon him and his holy progeny), who were given the fifth, includes the families of Ali, Abbas, Ja'far, and Aqil.
- .... Ibn Abi Shaybah narrated from Mujahid who said: The family of Muhammad (peace be upon him and his holy progeny) was not permitted to accept alms, so a fifth of the fifth was made permissible for them.

- .... Ibn Abi Shaybah, Abu Shaykh, Ibn Marduyah, and al-Bayhaqi in his Sunan narrated from Amr ibn Shu'ayb, from his father, from his grandfather, that the Prophet (peace be upon him and his holy progeny) would grant additional shares (nafl) before the mandatory rule of the fifth (khums) in war gains was revealed. When it was revealed: {And know that whatever you obtain of anything, then indeed, for Allah is one fifth of it and for the Messenger and for those related by blood} (Surah al-Anfal 8:41), he ceased granting additional shares and made that part of the fifth of the fifth, which is the share of Allah and the share of the Prophet (peace be upon him and his holy progeny).

- Al-Muthanna narrated to me, saying: Hajjaj narrated to us, saying: Abu 'Awaneq narrated to us, from al-Mughira, from his companions, from Ibrahim: {And know that whatever you obtain of war booty - then indeed, it is for Allah and for the Messenger and for [his] near relatives (Al-Anfal 8:41)} said: Everything belongs to Allah; the fifth is for the Messenger, for the near relatives, the orphans, the needy, and the traveler. Others said: This means that Allah's House has its fifth, and it is for the Messenger.

- Beshar ibn Mu'adh narrated to us, who said: Yazid narrated to us, who said: Sa'id narrated to us, from Qatadah regarding his statement: {And know that whatever of war booty you obtain, then indeed, for Allah is one fifth of it and for the Messenger and for [his] near relatives and the orphans, the needy, and the traveler (Al-Anfal 8:41)} he said: When the Prophet (peace be upon him) would obtain a bounty, it would be divided into five parts, one part for Allah and His Messenger, and the Muslims would divide what remained. The one fifth that was designated for Allah and His Messenger and the near relatives, orphans, needy, and traveler would thus be this one fifth divided into five parts: one part for Allah and His Messenger, one part for the near relatives, one part for the orphans, one part for the needy, and one part for the traveler.

- Harun ibn Maruf narrated to us, who said: Itqab ibn Bashir narrated to us, from Khasif from Mujahid regarding His statement: {And know that your possessions and any plunder seized in the name of Allah and His Messenger, and for His near relatives, is for Allah and the Messenger and for His near relatives, and for orphans, the needy, and the traveler, if you have believed in Allah and in that which We sent down to Our Servant on the Day of Criterion, the Day when the two armies met.} (Surah al-Anfal 8:41) He said: So the Prophet (peace be upon him) and his relatives would not eat anything from the charity (sadaqah) that was not lawful for them. For the Prophet, there is one-fifth of the fifth, and for his relatives, one-fifth of the fifth, and for orphans, one-fifth of the fifth, and for the needy, one-fifth of the fifth, and for the traveler, one-fifth of the fifth.

- Abd al-Baqi ibn Qani' narrated to us, who said: Ali ibn Muhammad narrated to us, who said: Musaddad narrated to us, who said: Ma'mar narrated to us, who said: I heard my father narrating from Jaish, from Ikrimah, from Ibn Abbas, who said: Nufal ibn al-Harith sent his two sons to the Messenger of Allah (peace be upon him and his holy progeny), and he said: "Go to your uncle; perhaps he will put you to work on the charity." They came and informed the Prophet of Allah (peace be upon him and his holy progeny) of their need. The Prophet of Allah (peace be upon him and his holy progeny) said to them: "It is not lawful for you, O People of the House, to receive anything from the charities, for they are the leftovers of hands. What you have in the fifth of the fifth (one-fifth of the spoils) will be sufficient or provide for you."

Likewise, it is forbidden for both of them to take from the money vowed as charity, as my Sheikh upheld this due to the generality of his (peace be upon him and his holy progeny) statement: "Indeed, these charities are not lawful for Muhammad or the family of Muhammad." Narrated by Muslim And he said: "I do not make anything permissible for you, O People of the House, from charities or the washings of hands. For you have in the fifth of the fifth what is sufficient for you or can enrich you; rather, it will enrich you." Narrated by al-Tabarani.
