16327 - He said: Uthman ibn Umar narrated to us, saying: Yunus narrated to us, from al-Zuhri, from Sa'id ibn al-Musayyib, who said: Jubayr ibn Mut'im narrated to us that the Messenger of Allah (peace be upon him and his holy progeny) did not distribute anything from the fifth (khums) to Abd Shams or to the sons of Nawfal, as he used to distribute to Banu Hashim and Banu al-Muttalib and that Abu Bakr used to distribute the fifth in a manner similar to the distribution of the Messenger of Allah (peace be upon him and his holy progeny), except that he did not give the relatives of the Messenger of Allah (peace be upon him and his holy progeny) as the Messenger of Allah (peace be upon him and his holy progeny) used to give them. Umar (r) and عثمان after him would give to them from it.

Narrated Jubair b. Mu'tim:

The Messenger of Allah (s.a.w.a.) did not divide the fifth among the Banu 'Abd Shams and Banu Nawfal as he divided among the Banu Hashim and Banu 'Abd al-Muttalib. He said: Abu Bakr used to divide (the fifth) like the division of the Messenger of Allah (s.a.w.a.), except that he did not give the relatives of the Messenger of Allah as the Messenger of Allah (s.a.w.a.) himself gave them. 'Umar used to give them (from the fifth) and those who followed him.

Ibn Abi Hatim and Abu Shaykh narrated from Sa'id ibn Jubayr (may Allah be pleased with him) regarding his statement: {And know that whatever you obtain of war booty (Surah al-Anfal 8:41)} meaning from the polytheists {for indeed, Allah and His Messenger and those in authority among you (Surah al-Anfal 8:41)} meaning the relatives of the Prophet (peace be upon him and his holy progeny) {and the orphans, the needy, and the traveler in need} (Surah al-Anfal 8:41) meaning the guest. Muslims would give one-fifth of what they gained during the time of the Prophet (peace be upon him and his holy progeny), and they would treat that one-fifth as four quarters. One quarter would be for Allah, the Messenger, and the relatives of the Prophet (peace be upon him and his holy progeny). What was for Allah would be for the Messenger and the relatives, and the Prophet (peace be upon him and his holy progeny) would have a share as a man from the relatives. The second quarter would be for the Prophet (peace be upon him and his holy progeny), the third quarter for the needy, and the fourth quarter for the traveler in need. They would take what remained and divide it among their shares. When the Prophet (peace be upon him and his holy progeny) passed away, Abu Bakr (may Allah be pleased with him) returned the share of the relatives, which he would send forth in the way of Allah, and the shares of the orphans, the needy, and the travelers in need remained.

4429 - Narrated: 'Amr ibn al-Harith who said: Mahbub ibn Musa narrated to us who said: Abu Ishaq al-Fazari narrated to us who said: Sufyan narrated to us from Qays ibn Muslim: I asked al-Hasan ibn Muhammad about the statement of Allah: {And know that your possessions and your obtainings, in truth, a fifth of it is for Allah and the Messenger} (Surah al-Anfal 8:41). He said: This is the key to Allah's speech concerning this world and the Hereafter. He continued: They disagreed about these two shares after the death of the Messenger of Allah (peace be upon him and his holy progeny), the share of the Messenger and the share of the Close Relatives. Then one said: The share of the Messenger is for the caliph after him. And another said: The share of the Close Relatives is for the relatives of the Messenger of Allah (peace be upon him and his holy progeny). And another said: The share of the Close Relatives is for the relatives of the caliph. So their opinions converged to place these two shares in horses and provisions in the cause of Allah. Thus, this was during the caliphate of Abu Bakr and Umar.

- Ibn Bashar narrated to us, who said: Abd al-Rahman narrated to us, who said: Sufyan narrated to us from Qais ibn Muslim, who said: I asked al-Hasan about Allah's statement: {And know that whatever you obtain of war booty - then indeed, it is for Allah and the Messenger (Al-Anfal 8:41)}. He said: This is the key to Allah's speech about this world and the Hereafter. Then the people differed regarding these two shares after the death of the Messenger of Allah (peace be upon him and his holy progeny). Some said: The share of the Prophet (peace be upon him and his holy progeny) is for the relatives of the Prophet (peace be upon him and his holy progeny), and others said: The share of the relatives is for the relatives of the Caliph. They all agreed to allocate these two shares towards horses and equipment in the path of Allah, and they remained thus during the caliphate of Abu Bakr and Umar (may Allah be pleased with them). Ahmad ibn Ishaq narrated to us, who said: Abu Ahmad narrated to us, who said: Sufyan narrated to us from Qais ibn Muslim, who said: I asked al-Hasan ibn Muhammad, and he mentioned something similar.

- Ibn Waki' narrated to us, saying: Umar ibn Ubayd narrated to us, from al-A'mash from Ibrahim, who said: Abu Bakr and Umar (may Allah be pleased with them) would place the share of the Prophet (peace be upon him and his holy progeny) in horses and weapons. So I asked Ibrahim, "What would Ali (may Allah be pleased with him) say about this?" He replied: Ali was the most assertive of them in this matter.

- Al-Muthanna narrated to me, who said: Abdullah ibn Salih narrated to me, who said: Mu'awiyah narrated to me from Ali from Ibn Abbas, concerning his statement: {And know that your gain of anything, then indeed, it is for Allah and the Messenger and for [his] near relatives and the orphans, the needy, and the traveler} (Al-Anfal 8:41). Ibn Abbas said: So the gain would be divided into five parts, four of which were for those who fought for it, and one fifth would be divided among four: for Allah, for the Messenger, for [his] near relatives, meaning the relatives of the Prophet (peace be upon him and his holy progeny). Therefore, what was for Allah and the Messenger was for the relatives of the Prophet (peace be upon him and his holy progeny), and the Prophet (peace be upon him and his holy progeny) did not take anything from the fifth. When Allah took up His Messenger (peace be upon him and his holy progeny), Abu Bakr (may Allah be pleased with him) returned the share of the relatives to the Muslims and began to carry it in the way of Allah, because the Messenger of Allah (peace be upon him and his holy progeny) said: "We do not leave behind inheritance; what we leave is charity."

- Ibn Bashar narrated to us, who said: Abd al-A'la narrated to us, who said: Sa'id from Qatadah, that he was asked about the share of the near relatives. He said: It was food for the Messenger of Allah (peace be upon him and his holy progeny), and when he died, Abu Bakr and Umar treated it as a charity in the way of Allah on behalf of the Messenger of Allah (peace be upon him and his holy progeny). Others said that the share of the near relatives after the Messenger of Allah (peace be upon him and his holy progeny) was with the share of the Messenger of Allah (peace be upon him and his holy progeny) until the authority of the Muslims.
