Permissiblility of Nikah al dobor near opponents

Hadith No: 1

Narrated Nafi`:

Whenever Ibn `Umar recited the Qur'an, he would not speak to anyone till he had finished his recitation. Once I held the Qur'an and he recited Surat-al-Baqara from his memory and then stopped at a certain Verse and said, "Do you know in what connection this Verse was revealed? " I replied, "No." He said, "It was revealed in such-and-such connection." Ibn `Umar then resumed his recitation. Nafi` added regarding the Verse:--"So go to your tilth when or how you will" Ibn `Umar said, "It means one should approach his wife in .."

And Abu Bakr ibn al-Arabi said in (Siraj al-Muridin): Al-Bukhari mentioned this hadith in the context of tafsir and said: (comes to her in) and left a blank, and the issue is well-known: Muhammad ibn Sahnun authored a section on it, and Ibn Sha'ban wrote a book on it, indicating that the hadith of Ibn Umar is about coming to a woman from behind.

- Mention of the second opinion on the verse: Ishaq ibn Rahwayh narrated in his Musnad and Tafsir, and al-Bukhari and ibn Jarir narrated from Nafi', who said: "One day, I was reciting: {Your women are a tilth for you, so go to your tilth however you wish (al-Baqarah 2:223)}. Ibn Umar said: 'Do you know in what this verse was revealed?' I replied, 'No.' He said: 'It was revealed concerning approaching women in their anuses.'"
- Al-Bukhari and ibn Jarir narrated from Ibn Umar: {Your women are a tilth for you, so go to your tilth however you wish (al-Baqarah 2:223)} and he said, 'In the anus.'
- Al-Khatib narrated in Rawat Malik from the direction of al-Nadr ibn Abdullah al-Azdi, from Malik, from Nafi', from Ibn Umar, regarding His statement: {Your women are a tilth for you, so go to your tilth however you wish (al-Baqarah 2:223)} who said: "Whether in her vagina or in her anus."
- Al-Hasan ibn Sufyan narrated in his Musnad, and al-Tabarani in al-Awsat, and al-Hakim and Abu Na'im in al-Mustakhraj with a حسن (hasan) chain from Ibn Umar, who said: "This was only revealed to the Messenger of Allah (peace be upon him and his holy progeny): {Your women are a tilth for you, so go to your tilth however you wish (al-Baqarah 2:223)}, as a concession for approaching in the anus."
- Ibn Jarir and al-Tabarani in al-Awsat, and Ibn Marduyah and Ibn al-Najjar narrated with a حسن (hasan) chain from Ibn Umar: that a man had intercourse with his wife in her anus during the time of the Messenger of Allah (peace be upon him and his holy progeny), and the people found this objectionable and said, 'Will you recite it?' Then Allah revealed: {Your women are a tilth for you, so go to your tilth however you wish (al-Baqarah 2:223)}.
- Al-Khatib narrated in Rawat Malik from the route of Ahmad ibn al-Hakam al-Abdi, from Malik, from Nafi', from Ibn Umar, who said: "A woman from the Ansar came to the Prophet (peace be upon him and his holy progeny) complaining about her husband, and Allah revealed: {Your women are a tilth for you, so go to your tilth however you wish (al-Baqarah 2:223)}."
- Al-Nasa'i and ibn Jarir narrated from the route of Zayd ibn Aslam, from Ibn Umar: that a man approached his wife in her anus and felt a great agitation about it, and Allah revealed: {Your women are a tilth for you, so go to your tilth however you wish (al-Baqarah 2:223)}.
- Al-Daraqutni narrated in Gharib Malik from the route of Abi Bashar al-Dolabi, who said: Abu al-Harith Ahmad ibn Sa'id narrated to us: Abu Thabit Muhammad ibn Ubaydullah al-Madani narrated to me that Abdulaziz ibn Muhammad al-Darawardi narrated from Abdullah ibn Umar ibn Hafs, Ibn Abi Dh'u'b, and Malik ibn Anas, each of them separately from Nafi', who said: "Ibn Umar said to me, 'Hold onto the Mus'haf, O Nafi', and read until you reach': {Your women are a tilth for you, so go to your tilth however you wish (al-Baqarah 2:223)}. He said to me, 'Do you know in what this verse was revealed?' I replied, 'No.' He said, 'It was revealed about a man from the Ansar who had intercourse with his wife in her anus, and the people greatly disapproved of this, so Allah revealed': {Your women are a tilth for you, so go to your tilth however you wish (al-Baqarah 2:223)}." I asked him, 'From her anus or her vagina?' He replied, 'No, only in her anus.'"
- Al-Rafa'i said in his فوائد (Fawa'id), citing al-Daraqutni: Abu Ahmad ibn Abdus narrated to us: Ibn al-Ja'd narrated to us: Ibn Abi Dh'u'b narrated to us from Nafi' from Ibn Umar, who said: "A man had intercourse with his wife in her anus, and Allah revealed": {Your women are a tilth for you, so go to your tilth however you wish (al-Baqarah 2:223)}. I said to Ibn Abi Dh'u'b, 'What do you say about this?' He replied, 'What more can I say after this?'"
- Al-Tabarani, Ibn Marduyah, and Ahmad ibn Usamah al-Taghiyabi narrated in فوائد (Fawa'id) from Nafi', who said: "Ibn Umar recited this Surah and came to this verse: {Your women are a tilth for you, so go to your tilth however you wish (al-Baqarah 2:223)} and said: 'Do you know in what this verse was revealed?' He replied, 'No.' Ibn Umar said, 'Concerning men who used to approach women in their anuses.'"
- Al-Daraqutni and Daalij both narrated in Gharib Malik from the route of Abi Mus'ab and Ishaq ibn Muhammad al-Qurashi, both from Nafi', from Ibn Umar, that he said: "O Nafi', hold onto the Mus'haf," and he read until he reached: {Your women are a tilth for you, so go to your tilth however you wish (al-Baqarah 2:223)} and said: "O Nafi', do you know in what this verse was revealed?" He replied, "No." Ibn Umar said, "It was revealed about a man from the Ansar who had intercourse with his wife in her anus and felt uneasy about it, so he asked the Prophet (peace be upon him and his holy progeny), and Allah revealed the verse." Al-Daraqutni stated, "This is established from Malik." Ibn Abd al-Bar said, "The narration from Ibn Umar in this regard is authentic and well-known from him."
- Ibn Rahwayh, Abu Ya'la, Ibn Jarir, al-Tahawi in Sharh Mashkilat al-Athar, and Ibn Marduyah narrated with a حسن (hasan) chain from Abu Sa'id al-Khudri: that a man had intercourse with his wife in her anus, and the people protestedagainst him, saying, 'Will you recite it?' Then Allah revealed: {Your women are a tilth for you, so go to your tilth however you wish (al-Baqarah 2:223)}.
- Al-Nasa'i, al-Tahawi, and Ibn Jarir, and al-Daraqutni narrated from the route of Abd al-Rahman ibn al-Qasim from Malik ibn Anas, that it was said to him: "O Abu Abdullah, people are narrating from Salim ibn Abdullah that he said: 'The servant or the brute is lying about my father.'" Malik replied: "Testify that Yazid ibn Rumaan told me that Salim ibn Abdullah informed him, from Ibn Umar, something similar to what Nafi' said." It was said to him: "But al-Harith ibn Ya'qub narrates from Abu al-Habab Sa'id ibn Yasar that he asked Ibn Umar, and Ibn Umar said: 'O Abu Rahman, we buy maidservants. Should we perform al-tahmid for them?' Malik said: 'What is al-tahmid?' and when he mentioned to him the anus, Ibn Umar said: 'Ugh! Ugh! Can a believer do that?' or he said: 'Can a Muslim do that?'" Malik added: "Testify that Rabi'a told me, from Abu al-Habab, from Ibn Umar, something similar to what Nafi' said." Al-Daraqutni said: "This is preserved from Malik and is correct."
- Al-Nasa'i narrated from the route of Yazid ibn Rumaan, from Ubaydullah ibn Abdullah ibn Umar: that Abdullah ibn Umar did not see any harm in a man having intercourse with a woman in her anus.
- Al-Bayhaqi narrated in his Sunan from Muhammad ibn Ali, who said: "I was with Muhammad ibn Kab al-Qurazi when a man came to him and said: 'What do you say about having intercourse with a woman in her anus?' Muhammad ibn Kab replied: 'This is an old man from Quraysh. Ask him,' pointing to Abdullah ibn Ali ibn al-Sa'ib. The man said: 'It is filthy, even if it is permissible.'"
- Ibn Jarir narrated from al-Darawardi, who said: "It was said to Zayd ibn Aslam that Muhammad ibn al-Munkadir forbade having intercourse with women in their anuses, and Zayd replied: 'I testify about Muhammad that he told me he does it.'"
- Ibn Jarir narrated from Ibn Abi Mulaykah, who was asked about having intercourse with a woman in her anus, and he said: "I attempted it with a maidservant of mine last night, but she resisted, so I had to use oil."
- Al-Khatib narrated in Rawat Malik from Abu Sulayman al-Jawzajani, who said: "I asked Malik ibn Anas about having intercourse with wives in the anus, and he said: 'I just washed my head of it.'"
- Ibn Jarir narrated in his book on marriage from the route of Ibn Wahb that Malik said it is permissible.
- Al-Tahawi narrated from the route of Asbagh ibn al-Farj, from Abdullah ibn al-Qasim, who said: "I did not see anyone I could follow in my religion who doubts that it is permissible," referring to having intercourse with a woman in her anus. Then he recited: {Your women are a tilth for you, so go to your tilth however you wish (al-Baqarah 2:223)} and said, "What could be clearer than this?"
- Al-Tahawi and al-Hakim in al-Manaqib al-Shafi'i and al-Khatib narrated from Muhammad ibn Abdullah ibn Abd al-Hakam, that al-Shafi'i was asked about it and said: "Nothing authentic has been reported from the Prophet (peace be upon him and his holy progeny) regarding its permissibility or prohibition, and the reasoning is that it is halal."
- Al-Hakim narrated from Ibn Abd al-Hakam: that al-Shafi'i debated Muhammad ibn al-Hasan on this, and Ibn al-Hasan argued with him that the term 'tilth' only applies to the vagina. Al-Shafi'i responded: "Does that mean everything else is forbidden?" Ibn al-Hasan agreed, and Al-Shafi'i continued: 'What if he were to have intercourse with her between her thighs or in her breasts? Would that be tilth?' Ibn al-Hasan replied, 'No.' Al-Shafi'i asked, 'Does that make it forbidden?' Ibn al-Hasan said, 'No.' Al-Shafi'i said, 'How can you argue with something you do not believe?' Al-Hakim said: "Perhaps al-Shafi'i said this in his earlier opinion, but in his later opinion, he specified prohibition."

- Al-Bukhari and others narrated from Nafi that he said: "I recited one day": {Your wives are a place of sowing for you, so come to your place of sowing from wherever you wish} (Al-Baqarah 2:223) Then Ibn Umar said, "Do you know in what this verse was revealed?" I replied, "No." He said, "It was revealed concerning approaching women from their rears."
- Al-Bukhari narrated from Ibn Umar that he said: {Your wives are a place of sowing for you, so come to your place of sowing from wherever you wish} (Al-Baqarah 2:223)
He said, "in the rear," and this has been reported from Ibn Umar through many routes.
- In a narration in al-Daraqutni, it is mentioned that Nafi said to him,
"from the rear or from the front?" He replied, "No, except from the rear."
- Al-Bayhaqi narrated in his Sunan from Muhammad ibn Ali, who said: "It was written in the presence of Muhammad ibn Kab al-Qurazi, and a man came to him and said,
'What do you say about having relations with a woman in her rear?' He replied, 'This is an old man from Quraysh, so ask him,' meaning Abdullah ibn Ali ibn al-Sa'ib.' The man said, 'It is filthy, even if it is permissible.'" The view of permissibility of this was also narrated from Muhammad ibn al-Munkadir with Ibn Jarir, from Ibn Abi Mliykah with Ibn Jarir as well, and from Malik ibn Anas with Ibn Jarir, al-Khatib, and others, and from al-Shafi'i with al-Tahawi, al-Hakim, and al-Khatib.

Know that those who narrated the permissibility of that, such as Ibn Umar, Abu Sa'id, and groups from both the earlier and later generations, should be understood to mean that their intention with coming to them in the anus was to approach them in the vagina from the direction of the anus, as the hadith of Jabir clarifies, and combining both acts is obligatory if possible.

14113 - Abu Abdullah al-Hafiz narrated to us, saying that Abu Abdullah Muhammad ibn Abdullah al-Saffar narrated to him, saying that Abu Muhammad Hamd ibn Muhammad al-Shafi'i narrated to him, from his uncle, meaning Ibrahim ibn Muhammad ibn al-Abbas, from his grandfather Muhammad ibn Ali, who said: I was with Muhammad ibn Kab al-Qurazi when a man came to him and said: O Abu Amr, what do you say about approaching a woman in her back? He replied: This is an elder from Quraysh, so ask him, meaning Abdullah ibn Ali ibn al-Sa'ib. Abdullah, however, had not heard anything on this matter. He said: O Allah, make it detestable, even if it were permissible...

He turned away from him and said: Be silent. Then he added: This is an elder of Quraysh, so ask him, meaning Abdullah ibn Ali. Abdullah ibn Ali ibn al-Sa'ib said: "O Allah, what filth, even if it were permissible..."

4386 - Ahmad ibn Dawud narrated to us, saying: Yaqub ibn Humayd narrated to us, saying: Abdullah ibn Nafi narrated to us, from Hisham ibn Sa'd, from Zayd ibn Aslam, from Ata ibn Yasar, from Abu Sa'id: that a man had intercourse with his wife anally, and the people reproached him for it, saying, "Are you forcing her?" Then Allah, the Almighty, revealed: {Your wives are a field for you, so go into your field as you will (Surah al-Baqarah 2:223)}. Abu Ja'far said: So some people took this to mean that it is permissible to have intercourse with a woman in her anus, and they supported this with this hadith, interpreting the verse as permitting such an act. Others, however, disagreed with them, disapproving of intercourse with women in their anuses and forbidding it, interpreting this verse in a different way.

- .... Abu Bakr ibn al-Arabi said: "Al-Bukhari recorded this hadith in (Tafsir) and said: 'He will come to her in a way that leaves a white area.'" He then concluded, "I say, we do not accept the claim of non-correspondence with what is in reality, because what is in reality, according to those who do not view it permissible to approach women from behind, is that it should be understood as after the word either in the vagina, or in the place of tilth." It appears from al-Bukhari's stance that he does not consider this permissible, but since there is something in the narration of Abu Sa'id al-Khudri that implies permission for it, he refrains from outright contradiction."

- .... Ibn Abd al-Hakam narrated from al-Shafi'i that he said: "Nothing reliable has been reported from the Messenger of Allah (peace be upon him and his holy progeny) regarding its prohibition or permissibility, and the presumption is that it is permissible."
Al-Hakim narrated from Muhammad ibn Abdullah ibn Abd al-Hakam, from al-Shafi'i, that he said: Muhammad ibn al-Hasan asked me, and I said to him: "If you intend to insist and assert the correctness of the reports, even if they are not authentic, you are more knowledgeable. And if you speak with equitable reasoning, I will respond to you with equitable reasoning." He said: "With equitable reasoning, I said, 'By what, then, did you consider it impermissible?' He said, 'By the statement of Allah, the Mighty and Majestic be He: "}{ 'Go to your tilth from wherever you wish' (Surah al-Baqarah 2:223) } and '(Surah al-Baqarah 2:222) }{ 'And approach them from where Allah has commanded you.'" I said, "And tilth can only be in the private parts." He replied, "Could this be considered impermissible for anything else?" He said, "Yes." I asked, "What if he were to engage in intercourse with her between her legs, or in her orifices, or under her arms, or if she took his member in her hand, or in that tilth?" He said, "No." I continued, "Would this be considered impermissible?" He said, "No." I asked, "Then why rely on something that has no evidence?" Al-Hakim then said, after recounting what al-Shafi'i had said, that perhaps al-Shafi'i intended this in his earlier opinion, but regarding his later opinion, it is commonly known that he deemed it impermissible.

- Al-Tahawi said: Muhammad ibn Abdullah ibn Abd al-Hakim narrated to us that he heard al-Shafi'i say: "Nothing authentic has been reported from the Messenger of Allah (peace be upon him and his holy progeny) regarding its prohibition or permissibility, and the default is that it is permissible."
- Asbagh ibn al-Farj narrated from Ibn al-Qasim from Malik, who said: "I have not seen anyone I could follow in my religion doubt that it is permissible," referring to the act of intercourse with a woman in her anus, and then he recited: {Your women are a tilth for you, so go to your tilth however you wish} (Surah Al-Baqarah 2:223). He said, "What could be clearer than this, and I do not doubt it."
- Ibn al-Qasim said: I said to Malik ibn Anas: "In our town of Egypt, Layth ibn Sa'd is narrating to us from al-Harith ibn Ya'qub from Abu al-Habbab Sa'id ibn Yasar, who said: I heard Ibn Umar say, 'What do you think of enslaved women? Should he express his approval to them?'" He replied, "And what is this expression of approval?" I mentioned the anus, and he said, "Does any Muslim do this?" Malik then said: "So bear witness that Rabi'ah ibn Abi Abd al-Rahman is narrating to me from Abu al-Habbab Sa'id ibn Yasar that he asked Ibn Umar about it, and he said, 'There is no harm in it.'"
- Ibn al-Qasim continued: Then a man in the gathering said: "O Abu Abdullah, you mention that Salim said: 'The servant lied, or the brute lied to my father' — meaning Nafi' — 'just as Ikrimah lied to Ibn Abbas.'" Malik replied: "And bear witness that Yazid ibn Rumman is narrating to me from Salim, from his father, that he used to do it."
- Abu Bakr said: Sulayman ibn Bilal narrated from Zayd ibn Aslam from Ibn Umar: "That a man came to his wife in her anus and felt uneasy about it, so Allah, the Exalted, revealed: {Your women are a tilth for you, so go to your tilth however you wish} (Surah Al-Baqarah 2:223). However, Zayd ibn Aslam is not known to have heard this directly from Ibn Umar.
- Abu Bakr added: The common view of Malik was the permissibility of this, and his companions deny that he ever made this statement due to its ugly and disgraceful nature, which is more known than they can dismiss with their denial. Muhammad ibn Sa'id narrated from Abu Sulayman al-Jawzajani, saying: "I was with Malik ibn Anas when he was asked about marriage in the anus, and he struck his hand to his head and said, 'I just washed from that this hour.'" Ibn al-Qasim also narrated this from him, as we mentioned, and it is recorded in legal texts.
- It is narrated from Muhammad ibn Kab al-Qurzhi that he did not see anything wrong with this and interpreted Allah's words: {Do you approach males among the worlds, and leave what your Lord has created for you of your wives? Rather, you are a transgressing people} (Surah Ash-Shu'ara 26:165-166) as similar, if that is what you desire.
